On May 14, the investigation agency under the Ministry of Public Security (MoPS) started prosecution and arrested Bui Quang Huy (45), general director of Nhat Cuong Technic Co., Ltd., for the charge of smuggling (Article 188 of the Criminal Code 2015) and offences against regulations of the law on accounting that lead to serious consequences (Article 221).

Eight other defendants have been arrested for the same charges. Huy has been accused for leading the crime organisation and directing cross-border smuggling, and using two accounting books to hide the revenue of trillions of dongs.

Five days ago, on May 9, 2019, the agency searched nine stores and warranty centres of Nhat Cuong Mobile, and seized dozens of boxes of documents and phones. The Nhat Cuong Mobile chain has been closed since then.

The agency also announced expanding the investigation to clarify the violations of the nine defendants and others, as well as seize property and assets.

For the charge of smuggling, Huy and the eight other defendants will be proposed 12-20 years in prison and 3-12 years for the charge of offences against regulations of the law on accounting that lead to serious consequences.

Nhat Cuong Mobile is the brand of Nhat Cuong Technic Co., Ltd., and started operations in 2001 as a phone repair shop. The company has nine retail stores and a warranty centre in Hanoi, and one ERP centre in Ho Chi Minh City.

In its registration certificate, Nhat Cuong's charter capital is VND38 billion ($1.65 million), and Bui Quang Huy is the legal representative of both the company and Nhat Cuong Software, which was established in 2016 to develop numerous IT projects in Hanoi like residential database and online residency software.
