MPI proposes 15 new conditional fields

Study abroad consultancy, education quality appraisal, and “.vn” domain registering and maintenance service are among fields that the Ministry of Planning and Investment (MPI) wants to add to the list of fields where entities have to satisfy certain conditions to do business.

According to the draft law submitted to the National Assembly for approval on November 7, the Ministry of Planning and Investment proposed adding 15 and removing 27 fields to the list.

Article 1(7) of the Law on Investment stipulates that a field of business has to have a possible impact on national security, defence, social order, safety, or moral and public health in order to be added to the list of conditional fields.

Dang Huy Dong, MPI’s Deputy Minister, said that the fields the ministry wants to remove have nothing to do with any of the critical areas as listed by Article 1(7). Regarding how the ministry decided which fields to add or strike out, he said the proposal was preceded by careful studies.

“We listened to government agencies, affected companies, and evaluated the impacts on related subjects. We propose removing an item from the list when the economic harm the inclusion causes is bigger than the benefit and vice versa,” he said.

Dau Anh Tuan, head of the Legislation Department of the Vietnam Chamber of Commerce and Industry (VCCI), said that companies are not afraid of conditions, but they are afraid of opaque conditions.

3.Managing and operating infrastructure
4.Appraising the quality of education
5.Consultancy services on studying abroad
6.Weather forecasting
7.Energy auditing
8.Building new and renovating fishing boats
9.Services on registering and maintaining “.vn” domains
10.Bonded warehousing
11.Selling hidden GPS trackers or equipment and software to record sound, images
12.Commercial testing of domesticated plant and animal breeds
13.Basic investigation services, consultancy on creating master plans, projects, and reporting on water resources
14.Training, recruiting, and supplying shipping crews
15.Producing, assembling, and importing cars
