The Handbook, compiled by lawyers and legal experts of ASL Law aims to support business owners and employees as the COVID-19 pandemic is creating mounting pressure in Vietnam's labour market.

The COVID-19 pandemic is leaving devastating impacts on the economy both globally and in Vietnam. Many firms had to curtail production, reduce jobs, or be forced to lay off workers to settle temporary difficulties.

Whether these solutions are carried out in compliance with the provisions of the law on labour, including regulations on legal procedures, application conditions, and the impacts need to be assessed in order to avoid unnecessary disputes. This is one of the issues drawing special attention from business owners at the moment.

The Handbook on COVID-19 was compiled based on questions about the problems and disputes that domestic and foreign enterprises have often faced in Vietnam.

Lawyer Pham Duy Khuong, managing director of ASL Law said the company's lawyers received the most questions in the past months about legal concerns related to the termination of labour contracts and the question of whether the COVID-19 pandemic constitutes a force majeure that provides the breaching party exemption from liability.

“Disputes over labour contracts are a top concern for both local and foreign businesses currently,” said lawyer Khuong.

The Handbook on COVID-19 was compiled based on questions about the problems and disputes that domestic and foreign enterprises have often faced in Vietnam.

The publication is a guideline for business owners and employees to better understand regulations. At the same time, the Handbook provides necessary guidance, helping the parties to come up with the best solutions during the pandemic time.

The Hanbook consists of two parts. Part I covers issues of workers' rights and advice on how to solve related issues, while Part II focuses mainly on contractual disputes related to force majeure events and solutions in case of illegal contract termination.

“The most frequently asked questions are addressed by ASL LAW's legal experts on each topic so that readers, business owners, and even employees can easily find answers. We hope that this legal handbook will be useful to readers,” said Khuong.
